(hereinafter referred to as "MSS")
1. Introductory provisions
These Terms and Conditions govern the use of services provided by Mobility Solutions & Services, a. s. (MSS). MSS primarily provides services in the areas of fleet management, parking (buses and passenger cars), vehicle maintenance and cleaning, toilet emptying, technical assistance, and other related additional services (hereinafter referred to as the "Services"). All orders for Services are subject to these Terms and Conditions, unless the contracting parties agree otherwise in writing.
2. Order and conclusion of contract
The contract between the customer ("Customer") and MSS is concluded upon confirmation of the order by MSS. Orders can be placed via the MSS reservation/ordering system, by email, or by other agreed means. The Customer shall specify the specific Service, place of provision, date, and time in the order. MSS shall send an order confirmation to the Customer's email address.
3. Prices and payments
The prices of the Services are listed in the current MSS price list or are agreed individually in the offer/order. Unless otherwise specified in the contract, prices are exclusive of VAT. Payment can be made by credit card, bank transfer, or other agreed method. Unless otherwise agreed, the price is payable within 7 days of order confirmation. In the event of delay, MSS is entitled to charge statutory interest on late payments and suspend the provision of Services until the amount due is paid.
4. Changes and Cancellations
The Customer may change or cancel a reservation without a cancellation fee no later than 24 hours before the scheduled start of the Service. In the event of cancellation at shorter notice or no-show, a cancellation fee of 100% of the price of the ordered Service will be charged. Changes to the date are subject to the capacity of MSS.
5. Customer rights and obligations
The customer is obliged to provide true and up-to-date information and to ensure that the vehicles handed over for the provision of Services are roadworthy and properly secured (locked, electrical appliances switched off, etc.). The customer is obliged to comply with the operating rules of the car park/premises and the instructions of MSS staff.
6. Liability and warranties
MSS is responsible for the proper provision of Services with professional care. MSS is liable for damage to vehicles occurring on the MSS premises only if the damage was demonstrably caused by a breach of MSS's obligations or negligence on the part of its employees. The customer is obliged to report obvious damage without undue delay, at the latest upon collection of the vehicle; hidden defects immediately after their discovery, and to allow MSS to investigate the damage. MSS is not liable for damage caused by force majeure (e.g., extreme weather), vandalism, or a third party, if it could not have been prevented with reasonable care.
7. Complaints
If the Customer is not satisfied with the Service provided, they may file a complaint within 14 days of the Service being provided. Complaints must be submitted in writing to nikol.vasku@mobilitysolutions-services.com with a description of the defect and order identification. MSS will handle the complaint without undue delay, no later than 30 days after delivery, unless a longer period is necessary for expert assessment (in which case MSS will inform the Customer).
8. Personal data protection
MSS processes personal data in accordance with applicable legal regulations, in particular the GDPR and related laws. Details on the purposes, scope of processing, retention period, and rights of data subjects are set out in the Privacy Policy published on the MSS website. 9. Use of cookies
The MSS website uses cookies to ensure functionality, measure traffic, and optimize the user experience.
10. Governing law and jurisdiction
These Terms and Conditions and the contractual relationship between MSS and the Customer are governed by the laws of the Czech Republic. The courts in Prague have jurisdiction to resolve any disputes. The right of the parties to resolve disputes out of court remains unaffected.
11. Changes to Terms and Conditions
MSS reserves the right to change these Terms and Conditions at any time. The updated version will be published on the MSS website and will be effective on the date of publication, unless MSS specifies a later effective date. For ongoing orders, the terms and conditions effective on the date of their confirmation apply, unless the parties agree otherwise.
